EB-2 National Interest Waiver (NIW)

EB-2 green card is for advanced degree holders and people with exceptional ability who obtain an National Interest Waiver and thus avoid the burdensome Labor Certification process. The NIW is suitable for postdoctoral researchers and early career scientists, including entrepreneurs. However, it is not limited to those in the sciences: artists, teachers, mental health professionals, and many other occupations may qualify if they meet the requirements.

The National Interest Waiver (NIW) allows you to “self-petition,” and fie a petition for green card on behalf of yourself without the involvement of an employer and a labor certification application. In summary, there are three major requirements that must be met to qualify for NIW:

1. The first requirement is that the you must show that your proposed endeavor is considered to have substantial merit and national importance. This merit can be shown through working in areas like business, science, technology, health, culture, or education.

2.  Second requirement is that you must be able to advance the proposed endeavor. This means that the USCIS will look at factors such as your educational background, experience, relevant skills, a record of similar successes, current progress, and having a plan for success.

You will not be required to prove that their endeavor will succeed, but rather that you are equipped to make it succeed if the opportunity arises.

3.  The final requirement is that you must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2. “On balance” simply means that the advantages of waiving the job offer requirement outweigh the advantages of not waiving it.
